Sales Terms & Conditions

Terms
All sales of products and/or services (“Goods”) at or through www.killerc.com or affiliated websites (“Killerc.com”) are governed by and subject to these sales terms and conditions (the “Terms”). By placing an order or making a purchase through Killerc.com, the buyer (hereinafter “Buyer”) accepts the Terms and agrees to be governed by and subject to the Terms.

Orders
All orders by Buyer constitute offers subject to final acceptance by KILLER CONCEPTS Inc and/or its wholly-owned subsidiaries (“KILLER CONCEPTS”). KILLER CONCEPTS may require additional information before processing an order. An order confirmation confirms receipt of an order and does not signify KILLER CONCEPTS’s acceptance of the order. KILLER CONCEPTS reserves the right to accept or decline an order at any time for any reason. KILLER CONCEPTS may, in its sole discretion, limit order quantity. If KILLER CONCEPTS cancels an order after billing, KILLER CONCEPTS will refund the billed amount.

If you would like to cancel a pending order, you can do so provided that the order has not yet entered the fulfillment process. If the order you want to cancel has already entered the fulfillment process, it cannot be canceled by you or by our customer service department. To cancel an order please sign into your account and cancel the order in your Purchase History or email support@killerc.com .

For all purchases made at Killerc.com, Customer shall be charged sales tax according to the state where the product is shipped. If Customer is tax exempt and has a valid tax exempt number, Customer should call KILLER CONCEPTS’s Customer Service at 1-949-215-9224 to place the product order and be prepared to provide the tax exempt number. KILLER CONCEPTS’s Customer Service shall not process any refunds for sales tax already paid for purchases made at Killerc.com or for purchases made through KILLER CONCEPTS’s Customer Service.

It is KILLER CONCEPTSs company policy we do not refund the sales tax amount and that it is the customers responsibility to request the refund from the state.

Please refer back to your accounting department for the proper filing on any taxes paid.

Prices
Prices shown on Killerc.com do not constitute offers. KILLER CONCEPTS reserves the right to change prices at any time without notice and to correct pricing errors. KILLER CONCEPTS does not match prices. Shipping and handling, expedited service, and taxes are not included in prices and will be added to the total price if applicable.

Shipping Estimations
Orders will ship as soon as practicable from when the completed order is received and payment is processed, unless noted at the time the order is placed or if you receive an email notice that an item in your order has been delayed. Preorders will ship at a future date. Any expected delivery dates that may be given are only estimates. Orders can be delayed due to verification or time of order being placed. Orders may be delivered in separate shipments. All purchases through Killerc.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon tender of the item to the carrier. Shipping of non-Dangerous Goods to the following locations may take additional time as compared to shipments within the continental U.S.

• Alaska, Hawaii, and Puerto Rico
• Other locations outside of the continental U.S.
• APO addresses (such as Armed Forces addresses overseas)

Shipping Restrictions
Lithium-Based Battery Shipments: Due to standalone lithium-based battery shipping restrictions, this product may only ship via ground and is subject to domestic and international shipping requirements. If the final ship-to address cannot be shipped to via ground, the order may be subject to cancellation. U.S. domestic orders to Alaska, Hawaii, Puerto Rico and the Virgin Islands are currently shipping via ground as well. International shipments from the U.S. are also prohibited for products with lithium-Based Batteries.

Delivery
Expected delivery dates are estimates. All deliveries are subject to modification or cancellation due to events beyond KILLER CONCEPTS’s reasonable control, including without limitation acts of God, compliance with any law, order, rule or regulation of any governmental or other authority, delay in transportation, labor disputes, strikes, failure of equipment or systems, or shortages of any labor or materials or services. All purchases through Killerc.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon tender of the item to the carrier.

Killerc.com offers the following payment methods:

• Credit cards: Visa, MasterCard, American Express, Discover, JTB and Diner’s Club

• PayPal, Sezzle, Amazon Pay, Bitpay Shop Pay and Apple Pay

KILLER CONCEPTS reserves the right to cancel or decline an order or payment method at any time for any reason. Coupon codes may be void for gift cards, specially priced/discounted products, and new product releases.

Refunds & Returns

Online Purchases of KILLER CONCEPTS Products
If, for whatever reason, you are dissatisfied with your purchase, contact us at support@killerc.com to request a return within 90 calendar days of purchase for a full refund, credit, or exchange, no questions asked. Your original receipt will be required. For warranty issues, contact us at support@killerc.com at any time during the warranty period. Customer is responsible for any necessary return shipping charges.

Claims for damaged or missing items must be received within two business days of receipt of merchandise.

Upon returning goods purchased directly from Killerc.com to us, please be cautious and do not include any non-KILLER CONCEPTS products, as they may be disposed of and unable to be retrieved.

Customer assumes any necessary shipping charges, or any other fees associated with the transportation of the product to our facility. Purchasing insurance on your return is encouraged as KILLER CONCEPTS is not responsible for lost or damaged products.

In-Store Purchases of KILLER CONCEPTS Products
If, for whatever reason, you are dissatisfied with your purchase, visit the branded retail outlet where you purchased the KILLER CONCEPTS product for a return or refund depending on their in-store returns / exchange policies. Your original receipt will be required. For all returns, please remember to include any accessories, such as cables or dock adapters. Please do not include any non-KILLER CONCEPTS items or data, as KILLER CONCEPTS cannot be responsible for them.

Counterfeits

Here at KILLER CONCEPTS Brands, we are dedicated to designing and manufacturing the very best, innovative solutions for our customers.

Your authentic KILLER CONCEPTS Brands products all carry a warranty but that warranty does not apply to counterfeit products.

KILLER CONCEPTS will only back products that are genuine KILLER CONCEPTS Brands products purchased directly from www.Killerc.com, in one of our stores or from one of our authorized partners.

Other Terms

Additional Terms and Conditions may apply to purchases of goods, contests, and promotions, all of which are made part of these Terms. If there is a conflict between these Terms and the terms posted for the specific purchase, contest or promotion, the terms posted for the specific purchase, contest or promotion will govern with respect to your participation or specific transaction

Limited Warranty
Any applicable limited warranty is available to the original retail purchaser only. For applicable limited warranty terms and conditions, please review the original packaging.

Limitations on Liability
THERE IS NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULL EXTENT DISCLAIMER IS PERMITTED BY LAW. IN ANY EVENT, ANY IMPLIED WARRANTY THAT MAY ARISE BY LAW IS LIMITED IN DURATION TO THE TERM HEREIN. THE REPAIR, REPLACEMENT, OR REFUND PROVIDED BY THE WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER REMEDIES. KILLER CONCEPTS WILL NOT BE LIABLE TO ANYONE FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND WHATSOEVER, INCLUDING WITHOUT LIMITATION PROPERTY DAMAGE, LOST PROFITS, OR ANY OTHER PECUNIARY DAMAGE, WHETHER DUE TO ANY DEFECT IN THE PRODUCT, BREACH OF THIS AGREEMENT, DELAY, NON-DELIVERY, NON-PERFORMANCE, RECALL, OR ANY OTHER REASON. ALL CLAIMS FOR NEGLIGENCE AND FOR FAILURE OF ESSENTIAL PURPOSE ARE EXPRESSLY WAIVED AND RELEASED. UNDER NO CIRCUMSTANCES WILL KILLER CONCEPTS’S LIABILITY FOR ANY DEFECT IN GOODS, WHETHER BASED ON CONTRACT, WARRANTY, OR ANY OTHER THEORY, EXCEED THE ORIGINAL PURCHASE PRICE OF THE PRODUCT. BY PURCHASING AND USING GOODS, BUYER ACKNOWLEDGES THESE LIMITATIONS AND WAIVERS, DECLARES THAT THEY HAVE BEEN READ AND UNDERSTOOD, AND AGREES TO BE SO BOUND.

Consumer Rights
SOME STATES AND OTHER LOCAL JURISIDCTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO SUCH A LIMITATION MAY NOT APPLY TO BUYER. SOME STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THAT EXCLUSION MAY NOT APPLY TO BUYER. THIS WARRANTY GIVES BUYER SPECIFIC LEGAL RIGHTS, AND BUYER MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION. BUYER ACKNOWLEDGES AND DECLARES THAT THESE LIMITATIONS AND WAIVERS HAVE BEEN BROUGHT TO BUYER’S ATTENTION AND EXPLAINED, THAT BUYER HAS READ AND UNDERSTANDS ALL TERMS AND AGREES TO BE SO BOUND, AND THAT BUYER'S RECEIPT OF THE AGREEMENT, LIMITED WARRANTY, AND GOODS, AND ANY PAYMENT FOR THESE, SIGNIFIES THAT BUYER HAS VOLUNTARILY AND KNOWINGLY CONSENTED TO ALL TERMS, INCLUDING THE WAIVERS AND LIMITATIONS CONTAINED HEREIN.

Modifications
Any changes to the Terms are binding and enforceable only if made in writing and signed by an authorized KILLER CONCEPTS officer. KILLER CONCEPTS does not agree to and rejects any proposed terms or conditions contained in an order or other documents that are in addition to, in conflict with, or inconsistent with the Terms. KILLER CONCEPTS RESELLERS, AGENTS OR EMPLOYEES ARE NOT AUTHORIZED TO MAKE ANY MODIFICATIONS, ADDITIONS OR EXTENSIONS TO TERMS OR WARRANTIES.

Intellectual Property
Buyer acknowledges KILLER CONCEPTS’s ownership of all trademarks, service marks, copyrights, imprints, rights of publicity, patents, design patents, registered designs, industrial designs, trade dress, product design, trade secrets and other intangible rights relating to the Goods (collectively “KILLER CONCEPTS Intellectual Property”) and acknowledges that Buyer will have no right, title or interest whatsoever in any KILLER CONCEPTS Intellectual Property.

Period of Limitation
No claim, suit, or other proceeding arising out of or related to the Goods or the Terms, including without limitation the Limited Warranty, may be brought by Buyer after one (1) year from the date it accrues. No discovery, estoppel, or other rule will apply to extend this limitations period.

Indemnity
Buyer agrees to indemnify and hold KILLER CONCEPTS, as well as its officers, agents, employees, and representatives, harmless from and against all claims, causes of action, liabilities, losses, damages, judgments, and proceedings, whether based in contract, quasi-contract, subrogation, tort, strict liability, or any other legal or equitable theory, including without limitation all expenses, costs, damages or injury to person or property, and attorney fees incident thereto, arising from or relating to the use, handling, storage, transportation, possession, processing, fabrication, resale, or any other activity involving the Goods after purchase. At KILLER CONCEPTS’s request, and subject to KILLER CONCEPTS’s sole discretion to choose its own counsel, Buyer will also defend KILLER CONCEPTS from any such claims, causes of action, or proceedings.

Enforcement
KILLER CONCEPTS may recover all expenses, including attorney’s fees, expert fees, and court costs, incurred to enforce the Terms or to pursue any lawsuit, arbitration, or other proceeding related to the Terms.

Applicable Law
The Terms will be considered to have been made in the State of Utah and will be governed by and interpreted under Utah state law, without giving effect to conflict of law principles. Except as provided below, any action, question, dispute, or claim arising out of or relating to the Terms may be brought only in a federal or state court in Salt Lake County, Utah, having jurisdiction over the subject matter, and Buyer irrevocably consents that such court will have personal jurisdiction over Buyer and waives any objection that the court is an inconvenient forum. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of KILLER CONCEPTS products) must be commenced within one (1) year after the claim or cause of action arises. THE BUYER WAIVES RIGHTS TO A JURY TRIAL AND/OR CLASS ACTION RELATING TO THE GOODS, AND MAY NOT JOIN OR CONSOLIDATE CLAIMS AS A REPRESENTATIVE OF A CLASS ACTION OR IN A PRIVATE ATTORNEY GENERAL CAPACITY.

Additional Rights
KILLER CONCEPTS has all rights and remedies given to KILLER CONCEPTS by applicable law, and KILLER CONCEPTS’s rights and remedies are cumulative and may be exercised from time to time by KILLER CONCEPTS. No waiver by KILLER CONCEPTS of any Terms shall operate as a novation or waiver of any other breach. KILLER CONCEPTS will not lose any right because it has not exercised that right in the past.

Miscellaneous
If any Term is invalid or unenforceable, that Term will be ineffective only to that extent, but the remaining provisions and Terms will be unaffected. Buyer’s rights may not be assigned or transferred. The Terms will be binding upon and enforceable by and against Buyer and KILLER CONCEPTS, and their respective legal representatives, successors, heirs and assigns.

General Warranty Terms

The KILLER CONCEPTS Warranty Policy (“Policy”) applies only to KILLER CONCEPTS branded products and are subject to the following terms: this Policy is non-transferable and is only available to the original end-user purchaser (“Purchaser”). To request a replacement product under the Policy, Purchaser must register the product at Killerc.com, provide proof of purchase and may be required to provide a valid credit card number. This Policy does not apply to products purchased from online vendors unauthorized to sell KILLER CONCEPTS product, including unauthorized sellers on websites such as Amazon and eBay. Products purchased at Killerc.com are automatically registered at the time of purchase. Shipping time and product availability may vary. Any third-party products sold by KILLER CONCEPTS must be serviced through the product manufacturer. To process a warranty in a Latin American country, Purchaser should return the product to the retail outlet where the product was purchased.

One-Year and Two-Year Manufacturer’s Warranty

KILLER CONCEPTS warrants these products against defects in materials and workmanship under normal use for a period of ONE (1) YEAR or TWO (2) YEARS, as applicable, from the date of retail purchase by the Purchaser. This warranty does not apply to normal wear and tear, damages caused by operating the product outside its intended use, unauthorized modification or alteration, or loss. To make a warranty claim, Purchaser must register the product at Killerc.com, provide proof of purchase by emailing a scanned receipt, and return the damaged product to KILLER CONCEPTS. If a valid claim is made during the applicable period, KILLER CONCEPTS, at its option, will either (1) replace the product, or (2) exchange the product with a product that is of equal value. At KILLER CONCEPTS’s discretion, KILLER CONCEPTS may replace the product with a refurbished product. A replacement product assumes the remaining warranty of the original product or shall have a ninety (90) days from the date of replacement, whichever is greater. If Purchaser is in the United States, KILLER CONCEPTS shall pay the shipping costs to ship the original product back to KILLER CONCEPTS. If Purchaser is not in the United States, Purchaser shall pay the shipping costs to ship the original product back to KILLER CONCEPTS. Purchaser shall pay the shipping costs for the replacement product. Failure to return the original product within sixty (60) days will result in the Purchaser’s credit card being charged the full retail price of the replacement product.

90-Day Return Policy

KILLER CONCEPTS offers a 90-day Return Policy, no questions asked on products purchased directly from Killerc.com. The product must be returned to the original place of purchase and Purchaser must provide proof of purchase. Purchaser shall have the option to replace the product at no charge, exchange the product with a product that is of equal value or receive a refund of the product purchase price. Products purchased through other retailers must be returned pursuant to those retailers’ return policies. Customized or personalized products and gift cards are not eligible for return. Customer is responsible for any necessary return shipping charges.

KILLER CONCEPTS IS NOT RESPONSIBLE FOR DAMAGES RESULTING FROM ANY BREACH OF WARRANTY, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF DATA, LOSS OF REVENUE, AND LOSS OF ANTICIPATED PROFITS. KILLER CONCEPTS’S WARRANTIES DO NOT COVER ANY THIRD-PARTY DEVICES OR THE PERSONAL PROPERTY OF ANY CONSUMER. THESE WARRANTIES DO NOT APPLY TO KILLER CONCEPTS SOFTWARE OR TO ANY THIRD-PARTY SOFTWARE. ANY ALTERATION, CHANGE, MODIFICATION, OR REPAIR (OTHER THAN REPLACEMENT OF A REPLACEABLE COMPONENT) MADE TO THE PRODUCT BY A PARTY OTHER THAN KILLER CONCEPTS OR KILLER CONCEPTS’S AUTHORIZED SERVICE PROVIDERS VOIDS ALL WARRANTIES. KILLER CONCEPTS RESERVES THE RIGHT TO REFUSE WARRANTY REPLACEMENT FOR SUSPECTED FRAUD OR ABUSE OF KILLER CONCEPTS’S WARRANTY POLICY CONTAINED HEREIN. KILLER CONCEPTS’S WARRANTIES AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. KILLER CONCEPTS SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF THE LAW PROHIBITS KILLER CONCEPTS FROM DISCLAIMING IMPLIED WARRANTIES OR WARRANTIES OF MERCHANTABILITY, ALL SUCH WARRANTIES ARE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

KILLER CONCEPTS RESELLERS, AGENTS OR EMPLOYEES ARE NOT AUTHORIZED TO MODIFY OR EXTEND KILLER CONCEPTS’S WARRANTIES. KILLER CONCEPTS RESERVES THE RIGHT TO CHANGE WARRANTY TERMS AND REMEDIES WITHOUT NOTICE.

The benefits conferred by these warranties are in addition to other rights you may have depending on your country, state or province of residence. Furthermore, some countries, states and provinces do not allow the exclusion or limitation of incidental or consequential damages or exclusions or limitations on the duration of implied warranties, so the above limitations or exclusions may not apply to you. If any provision of these warranties is unlawful, void or unenforceable, that provision shall be deemed severable and shall not affect any remaining provisions.
